NEW LEGISLATION INTRODUCED

The legislation written below has been introduced by RoAnn Destito (Democrat in the Assembly,Oneida County) as A9614. It was introduced in the Senate Joe Griffo (Republican in the Senate, Oneida County) as S6623. Tom Haas and I have worked with the Oneida County Distrct Attorney Scott McNamara during his recent run for office along with Represenatives Destito and Griffo to make this legislation a reality. For years District Attorneys statewide have been unable to prosecute inmates on felony charges unless we suffered serious phisical injuries when we are assaulted on the job. Please be ready to participate in contacting legislators to make this legislation a law. Please forward to all members in your address book. Key points in the bill are as follows.

A PERSON IS GUILTY OF AGGRAVATED HARASSMENT OF A POLICE OFFICER OR PEACE OFFICER WHEN, WITH THE INTENT TO HARASS, ANNOY, THREATEN OR ALARM A PERSON WHOM HE OR SHE KNOWS OR REASONABLY SHOULD KNOW TO BE A POLICE OFFICER OR PEACE OFFICER ENGAGED IN THE COURSE OF PERFORMING HIS OR HER OFFICIAL DUTIES, HE OR SHE STRIKES, SHOVES, KICKS OR OTHERWISE SUBJECTS SUCH PERSON TO PHYSICAL CONTACT. AGGRAVATED HARASSMENT OF A POLICE OFFICER OR PEACE OFFICER IS A CLASS E FELONY.
